Trauma Recovery
The West Virginia Trauma Recovery Unit recovers Medicaid resources for the Bureau for Medical
Services (BMS).
The Unit's primary function is to recover medical expenditures from verified third parties, which are liable for medical expenses when a Medicaid recipient has been awarded a settlement due to an accident. Third parties may include automobile insurance companies, hospital malpractice insurance carriers, employers, workers compensation carriers and homeowner insurance plans.
The Trauma Recovery Unit provides case management services for automobile accident, malpractice/negligence, personal injuries, workers' compensation, general liabilities, and any other trauma/tort recoveries.

Management of Trauma Recovery Unit
The Department of Health and Human Resources (DHHR) has contracted with HMS, Inc., a Gainwell Technologies Company, to manage and operate the Trauma Recovery Unit. The Recovery Unit operates under the State of West Virginia, DHHR Bureau for Medical Services. Section 1902(a)(25) of the Social Security Act requires that States or local agencies take all reasonable measures to identify legally liable third parties.
All recoveries are returned to WV BMS and the Federal Government.
Federal and State law require the State to pursue repayment of Medicaid funds from any third party responsible for injuries suffered by a Medicaid recipient.
